  1. Hmmmph. Not a single trick-or-treater at my house . . . again. Have not had one for 10 years. I think that's kind of weird in a decent middle class neighborhood that has what is considered to be the best elementary school in my metro area. Do people mostly take their kids to organized activities these days rather than generalized neighborhood trick-or-treating?

  2. So I have a totally off topic question. Some of you may have read our daughter tripped over a vacuum cleaning cord at one of the hotels in New Orleans late Sat. night. Her hands were in her pockets and she was unable to break her fall and landed face first on a concrete floor. She broke one of her front teeth and went to a dentist in Denver this afternoon. They fixed it temporarily with a composite but there's a possibility the root may be cracked and so they're sending her to an endodontist before repairing it permanently as she may need an implant. Should the hotel's insurance cover the cost or not? We don't know, and we're not very litigious around here, so I'm asking what you guys think. There was a report filed and apparently a video of it but the hotel said it would not be available until today. The dental office is contacting them on her behalf but we feel a little conflicted.

  3. okie, we don't get too many anymore either, but we're on a corner and so we always get a little wave of kids. It's only 6:00 here so we're still waiting. I put a few lights and decorations up yesterday just to get into the spirit. I used to love Halloween as a kid and since our daughter's birthday is the 30th. we always had some great Halloween parties for her when she was young.

  4. lms, sorry to hear about your daughter. I did not know the specifics. Not speaking to any legal aspects, but would she be happy with it if the hotel paid the "repair" expenses? Happy enough to let it go at that?She has my utmost sympathies, by the way. I did a similar face plant on concrete once without being able to break my fall. I turned my head, but it broke my cheekbone. Hurt like hell.

  5. Oh yeah, just the expenses would be helpful. We're not interested in anything else. I just know an implant is quite expensive and as a student still she really doesn't have the money for that. Of course we would pay for it, if need be. My mom fell on her face once and broke her nose walking on ice. Can't imagine breaking a cheek bone, yikes. Although I fell five years ago and was pretty seriously injured but not my face.

  6. I am not much of a slip and fall lawyer. Ask me about preemption or class certification issues, and I'm there, but not so much with ordinary trip and slip cases.Hard to say in a vacuum (pun) whether the hotel was negligent, but I would definitely ask the hotel for expenses on the assumption that it is liable.

  10. On a happier note, I took 2nd place today in our annual college-wide chili cookoff. I think it was only because I was the only one who made a vegetarian entry. LOL. I won a very nice hooded sweatshirt, but it's a men's size L. I'm 5'8" and weigh about 125. I could fit in it 3 times.

  11. lms, it never hurts to ask. In her later years, my mom took a serious fall in an Atlanta Wal-Mart while visiting my brother. It was their negligence. They could not wait to pay all of her expenses when they found out she was not interested in suing them. They had a paralegal call her once a week to see how she was doing, and she thought it was so nice that they were so concerned about her wellbeing. Yuk yuk.

  12. okie, congrats on the chili recipe. I make a lot of vegetarian chili in the winter so I understand the challenges. Lol on the sweatshirt. I'm about 5'9", 135 so I totally get it, sounds like a wear around the house or back yard sweatshirt.

  13. okie,I wish. But the sad truth is that during a slow time I overcommitted (way overcommitted) to speaking and writing gigs. Now I am drowning. If only you knew how amusing (and why) I find the taunts by the PLrs about my "creds." As I've noted more than once, I never mentioned being a lawyer until Tena and a couple of other old timers started saying I obviously knew nothing about law. I guess it's not really fair to say things like "if only you knew." A couple of people know why; if you want to know, I'll email it to you, but you'll understand why I don't like to go public.Congrats on the cookoff. Vegetarian chili doesn't seem right to me, though. : )

  16. Thanks all, re the chili. I personally have no qualms about being a meat eater, but I do have a couple of vegetarian chili recipes that I really like. Must admit, they are not your typical chili.qb, you're right that it's not fair to say "if only you knew." If it can't be public, email it? My email is available on my profile.

  18. We turned off the lights, ordered some take-out chinese, and headed over to some friends. We used to dress our dog as a bumblebee and let him answer the door. I loved watching the kids' reactions. We lost our dog four years ago and our son is at college. Halloween is not a holiday that brings joy to me anymore. It's a little bah-humbugish if you can say such a thing about this particular holiday, but that is how I feel. I am glad others still get joy out of it.

  19. New neighborhood with TONS of the little kids, the ones that are the most fun to give the candy to. Only a handful of boys in the 12 – 13 range, and none older.Had a discussion today with one of my colleagues; her daughter and husband were arguing about whether daughter could go trick-or-treating. I suggested that, when she gets a driver's license (she just got her learner's permit) she's too old to go (although even that seems too old by about four years to me). I suspect it's that she's longing for that last little bit of girlhood, since my friend is pretty sure that she's starting to get her first serious infatuation with a boy.

  20. There must be something in the water here, we had one big bad wolf with a little red riding hood and just about all the rest have been little princesses, so cute though. We have flashing rings for all the kids this year, thank you Taiwan, and only one piece of candy and a small bag of pretzels.Yellojkt, I remember those lean years when all the kids were gone too, then the grandkids come along and you start all over.

But since I inexplicably do not get to experience that any more, even in a neighborhood with lots of young kids, my attitude about halloween now is more akin to yjkt.That said, it's my old lady bed time and I must sign off.   26. lmsinca- Louisiana is odd because it isn't a common law state, so I don't know how different or similar their slip and fall laws are to Michigan. However, in Michigan, slip and fall basically does not exits because most of the tieme a cord, a wet floor or piece of ice is considered open and obvious. That said, it doesn't hurt to ask and it doesn't hurt to mention that my friend, brother, sister etc is an attorney (even if not true). My brother didn't get his wedding photos for a year despite numerous calls. He finally called and said his brother is a lawyer and had the photos within a few days.
